READ THE CONTRACT MADE BETWEEN MR Foley AND CAPITAL VACATIONSYou will be astonished and see that this contract is definitely not what we members have asked for nor would we approve it.
Yes Capital vacations has to pay ABC $30.000 but in return gets to do all the rentals with the club-owned weeks except 4 needed per week for the renovation.
Than eventually it will get 15% of all our club rentals which is same thing as selling heart of our club.
Why is the contract not send out in a blast email? We have always been told how OPEN this BOD is yet you have to make an appointment to read the contract, than only Pam Cordell from CV or Luis from accounting have to be present when you read it because you are not allowed to make a picture or a copy.
WHY ,what is the BOD afraid of that there are illegal things in there, well my opinion is yes there are absolutely a few illegal sentences in there which no one in numbers is allowed to see because lawyers would have a field day with it.
Open BOD? never seen such a closed BOD cheating the members or misleading the members, it is pure terrible and that is my opinion, it is time we got some really qualified people in the BOD have not seen many in long time.- 06/24/2019 at 9:35 pm

olgaParticipantYou are wrong, they admitted the club bought up weeks and I know they did, so why say such nonsense, no resort needs next to 250-300 weeks for any renovation so please think what is logical, I only ask ,did you read the contract mr.Foley made with Capital Vacations? for if you did not, you have no idea what it is all about, but if you would read it your eyes might open. I fought for this club may years “only” because it is in my eyes the best place to be ,at least it always was and now I am worried as an owner things are not going the right way. We are all entitled to our opinions and being local only means I am here all year round and therefor see and experience more than most members , does not make me better or worse and my love for this place makes I will not just sit in the sun but try to do something about the concerns I have. Please read that contract ,this is such an open board ,so it should be easy for you to get permission to read it right? Just ask them.

olgaParticipantvery clever answer,, truth is I have seen nothing this capital vacation has added to the good of ABC yet, and to tell us to approve a proposed budget of $278.000 and what about the percentages of rentals and sales? is that included, to put is a “management” in the proposed budget fees so members do not even all understand this is ONLY for capital vacations, so far they hired a GM, put her on extended leave after only a few weeks because Capital made many changes not appreciated by the employees and the anger was put on the shoulders of that GM whatever happened after that is “private” but it cost us a bundle. aand our emails to the club are now read by capital and the BOD so OUR private information is open to them all . I certainly did not approve of having a management company who now tells us on top of everything renovations start in the wintertime and of the year, Really? one of the most crazy things I ever heard. That is when the club is sold out. Anyway this BOD takes Dutch law like it is invisible and does as it pleases, waste of money and Dennis you are totally correct we have articles of association and the BOD has to obey them but chooses not to do so many times unless it is accidental and these articles are not understood.

olgaParticipantKathy ,it is not just what it cost us in the package deal that was finally reached to get rid of an employee where the BOD never shared any information, not just personal but Any information at all. it also cost us legal fees and though the settlement was reached with out going to court, the legal fees will be pretty high so combine the 3 and it is not personal information, just letting the shareholders know how much we had to pay in salary when an employee was not working, the settlement fee and the legal fees, one number is sufficient. Since this is an OPEN BOD there should be no problem in letting us know right?

Now no GM ( saves lots of salary?) but a housekeeper manager and a person in USA are taking over the GM position and that is not normal and it is very much noticeable that things a not running as they should.- 04/23/2019 at 8:20 pm

olgaParticipantThe BOD ( in this case Rene Maduro) and their lawyer make an agreement in the contract , if they do not put in there that strike is not allowed when under contract that is in every contract different, you may remember I asked many times to read the contract between the union and the BOD, mr. Foley , who dictates everything,said NO that is forbidden yet I have read the contract of CDM and several other resorts and the topic “strike” was in there.- 03/21/2019 at 1:56 am

olgaParticipantI hope no one more gets ever to be handicapped and in a wheelchair, for than you would scream to get a handicapped toilet, jeez I cannot believe the egoism of some people.
And to see the joy of people playing tennis is so much fun, these courts so much more can be done with them, not only tennis but several sports they can be used for, but old BOD members only think about themselves never about the people young or sportive.
yet that alone is our future but what do they care, they do not play tennis, they are not in a wheelchair (yet) they never use the pool which is often filthy and full of mold ,soo great planning for our children and future generations.- 02/24/2019 at 9:57 pm

olgaParticipantI am not known to be the most diplomatic person but the language of the chairman now THAT is bad language and very offensive to a member in good standing,wow talking about being arrogant she did not deserve to be talked to like that this is unworthy of our club. sorry to say we are not in the army nor in the police force where this might be normal.

olgaParticipantSince I am not a tourist but a local member owning quit a few units and living in Aruba 52 weeks a year, unless I am on vacation elsewhere, I happen to know far more than most membersand I have visited many rooms , maybe you understand now why I am more critical for many rooms have no broken tiles at all. have a lovely day.- 11/11/2017 at 8:23 pm

In several meetings including the general members meeting I have asked Mr. Maduro specifically how much we had in the reserve fun.
His answer has always been the same “WE HAVE NOT A DIME IN THE RESERVE FUND”
SO WHO IS LYING HERE, MR. MADURO IR MR. Foley WHO ONCE AGAIN HAS TAKEN OVER THE COMPLETE BOD AND DOES IT ALL HIS WAY.he is the one and only ruler of the BOD.
Nice explanation, a million in “paper” deficit not cash deficit makes me laugh.
mr. Foley giving all the answers to the financial questions should tell you all, he sais we do have a reserve fund, mr. Maduro sais there is not a dime in that fund so who do you believe for one of them is lying big time.olgaParticipantHow very strange that mr. olgaParticipantmr Foley omits to tell you how many weeks are soon to be club owned weeks, if those that are behind with paying their maintenance fees soon ,we shall have very close to 200 club owned weeks. these weeks are not up for sale, nor are we even allowed to know which weeks nor which units these weeks are.
According to mr. Foley they are kept aside for the upcoming assessment but that is ridiculous for we do not need 200 units for an assessment .
What we need is the sales price and the maintenance fees of these club owned weeks.
Only a small number in most weeks of the year are needed for an assessment.
there is total different formula for that.
Not even John is allowed to know which weeks there are , now that makes me feel very uneasy for what are they hiding?

olgaParticipantSorry to say I totally disagree with Mr. Foley’s explanations.
First of all the person who asked if one worked only 2 years in one resort, that resort needs to pay nothing.
Everybody in Aruba gets a government pension, this is low but it sure helps.
This pension everybody would get as of 60 years old no matter the years of employment that age number is going up to 62 eventually will be 65 and in Holland it already is 67 years before you are eligible for that pension.Now Cessantia ONLY needs to be paid out when employees are being dismissed by the resort or employer, if the employees decide to stop working or to take another job, they get nothing from the previous employer.
But it is the custom to give employees who worked many years, who the employer wants to leave because they get too old, too slow or are just disliked by the BOD what is called a “Package Deal”.
For we have not yet an obligatory age where people must retire.
This ” package Deal”is usually one or two months salary.
if the employee thinks it is unfair what they get, they can always get the union to negotiate.So this BOD has set aside almost one million dollars for cessantia and that members is complete unlogical and in my eyes not correct for never do we have to pay that amount in cessantia unless the BOD decided to give every employee the sack.
So what they are doing with these financials is a mystery but one that is costing us members a lot of money and where it goes, the BOD nor the accountant are giving clear truthful answers.
Another word for the package Deal is the “mini pension ‘ a resort/employer has to pay this,it is very little money and therefor most employees chose the Package Deal which is paid in one time , again that is very little money compared to what they are telling you.
I asked mr, Foley a copy of the new agreement between ABC and the union, after 2 weeks he still has not even given me an answer, he had to consult with the (expensive) lawyer wow, got copies of those agreements of several resorts for shareholders have the right to have a copy at no cost.
So this BOD being “OPEN” what a joke, sorry I am very disappointed.
